Our total liability for any claims arising from or related to these terms or our services shall not exceed the amount paid by you to deltahubluae in the twelve months preceding the claim.

We do not warrant that our services will meet your specific requirements or that they will be error-free, secure, or continuously available. Educational institutions are responsible for making their own educational decisions based on the analytics and insights provided.

Indemnification

You agree to indemnify, defend, and hold harmless deltahubluae, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

Governing Law

These terms shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising from or related to these terms or our services shall be subject to the exclusive jurisdiction of the Irish courts.

For users located in other EU member states, nothing in these terms shall limit any mandatory consumer protection rights that may apply under local law.

Termination

Either party may terminate the service relationship with appropriate notice as specified in the service agreement. We reserve the right to terminate or suspend access to our services immediately if:

  • You violate these terms or our acceptable use policies
  • Your account becomes delinquent on payment obligations
  • We are required to do so by law or regulation
  • Continued provision of services would create security or legal risks

Upon termination, your right to access and use our services will cease immediately. We will provide reasonable assistance in data export according to our data retention and deletion policies.

Severability
